Definitions:
 General.
'You'
Any person, individual or entity. 
'User(s)'
Any person, individual or entity that brows in or using the InfoCountry service or information.
'This site' or 'this web site'
Referring to the InfoCountry web site.
'Province' and 'Town'
A country
(in this case: South Africa specifically) is divided into provinces and each province is further divided into towns. A town is referred to as part of a landscape area which mainly provides their own facilities and requirements to the community and environment.
  
For this web site specific.
'InfoCountry'
This website, which provides information and communication within every town separately and which hosts a registered business information on a centralized located database. InfoCountry is a centralized information system.
'JBNet.co.za'
The owners of InfoCountry, but operates as a third-party web site which provide services to InfoCountry.
'USFIE'
An Internet standard for the layout and structure of an Users or Surfers Friendly Interface or Environment. USFIE is owned and copyrighted by JBNet.co.za owner.
'InfoCountry divisions'
or in short 'division(s)'

InfoCountry
is divided within three (3) divisions. These divisions are: JBNetInfo, InfoTown and InfoBiz. Each division concentrates on specific contents and provides their own services.
'JBNetInfo'
Information from JBNet which is available on the InfoCountry web site.
'InfoTown'
The service from InfoCountry which concentrates on information and communication form individuals for each town separately.
'InfoBiz'
The service from InfoCountry which provides a full centralized information system to businesses for each town separately.
'MIS'
Management Information System. Each division contain their own MIS to capture, update and maintain the services that InfoCountry provides.
'JBNet'
The management and employees from JBNet.co.za. They provide a service to InfoCountry and maintain the JBNetInfo division.
'Supervisor'
People employed by InfoCountry to maintain InfoTown and InfoBiz. There is one(1) Supervisor for each town.
'Editor'
People employed by Supervisors via InfoCountry to maintain the InfoBiz data. The total Editors for each town vary. 
'Business'
Any person or persons who do trade. 
'Registered Business' or 'InfoCountry's business'
A business which is registered with InfoCountry's web site and which hosts their business information on the InfoCountry's databases.
'Customer'
The registered business who may interact with the MIS within the InfoBiz devision
'Approved' or 'Approval'
The status in which a registered business is in. There are five(5) approvals which are: Under Construction (in short: 'UnderC'), Approved (in short: 'App'), Unapproved (in short: 'UnApp'), Hold and Cancelled.

'JBNumber' or 'BURN'
This is a Business Unique Reference Number (BURN) which is used to identify and locate a registered business information from the InfoCountry databases.
'InfoBiz service documentation'
Documentation that list all the services that InfoBiz via InfoCountry provides for a registered business.

'Recommended updates'
A set of instructions, available within the InfoBiz MIS, which must be updated before the registered business can be set to 'approved' 

 

 

ANY PERSON OR PERSONS THAT ACCESS THE INFOCOUNTRY WEB SITE OR USES THE INFORMATION RETRIEVED FROM IT WILL BE BOUND TO THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS YOU MUST LEAVE THE INFOCOUNTRY WEB SITE IMMEDIATELY AND NOT USE ANY OF THE INFORMATION YOU RETRIEVED FROM IT. ANY FURTHER USE WILL AUTOMATICALLY BIND YOU TO THESE TERMS AND CONDITIONS.

1. AGREEMENT AMENDMENTS
1.1 The Agreement can be modified at any time. 
1.2 Modifications to this agreement shall be effective immediately upon posting. 
1.3 You agree to review the Agreement periodically to be aware of such modifications. 
You are requested to review these Terms and Conditions each time you access the web site.
1.4 Should you continue accessing the service, you deemed your conclusive acceptance of the modified Agreement.   

2. INTELLECTUAL PROPERTY RIGHTS
2.1 InfoCountry is owned by the
JBNet.co.za web site owner, but operates as a web site and business of it's own. 
2.2 The words "InfoCountry", "JBNet" and "USFIE" and their respectively logos as-well-as the words "JBNumber", "JBNetInfo" and "InfoTown" are all registered trademarks of the
JBNet.co.za web site owner in South Africa. 
2.3 The JBNumber, the layout and the collective working principles are patented by the South African patent offices in Pretoria and owned by the
JBNet.co.za web site owner. 
2.4 All intellectual property
included in this web site, including but not limited to the text, design, the interfaces and underlying source code are copyrighted to InfoCountry under the South African and other countries copyright laws. The copyright in the contents of the site resides with its authors and the responsibility with the providers of such information. The use of the information on any other web site or for any commercial purposes is prohibited. The cooperative design and methods used in the web site includes work that is licensed to InfoCountry

3. SERVICES DISCLAIMER
3.1 The information on the web site is provided "AS IS". All contents on the web site, such as text, images and information references obtained from InfoCountry, is for informational purposes only. 
3.2 None of the information is intended nor implied to be professional advice and is not intended to replace personal consultation, professional advisors, attorneys or any other profession.
 
3.3 InfoCountry does not claim that the information retrieved from the Service is accurate, appropriate, complete, precise,
reliable, helpful or free from any errors.
3.4 People will use this information at their own risk. 
3.5 InfoCountry
does not operate, control or endorse any information on the Internet in any way and in no event shall InfoCountry or their third-parties providers be liable for any costs or damage, no matter when or how it may arise, (including, but not limited to the, loss of profits, programs, data, clients or business interruption, and such) which may arise from the use or inability to use the Service. 
3.6 JBNet reserves the right to 
3.6a modify,; 
3.6b change th
e contents and/or services available from the InfoCountry web site, at any time; 
3.6c discontinue any division or service/s from
InfoCountry;
3.6d
change the software and hardware required to access the service without any approval from anyone or;
3.6e assign its rights and duties under this Agreement to any party at any time without notice to you. 
InfoCountry will act within its sole and absolute discretion. 

4. WARRANTY
4.1a
InfoCountry does not warrant that the Service will be uninterrupted (due to updates or other causes beyond the reasonable control of the Service),
4.1b error-free, 

4.1c access to the web site is always available (due to the nature of electronic transmission and Internet capabilities)

or that defects in the Service will be corrected.
4.2 Any information retrieved from
InfoCountry is not guaranteed or warranted to be free from infection or viruses, worms, bugs, Trojan horses or any other harmful code or elements. It is the responsibility of the users of this site, to install the proper hardware and/or software to satisfy their specific needs and requirements. 

5. POSTED INFORMATION
5.1 Posted information liabilities (Relevant to all Divisions).
5.1.1
InfoCountry takes no liability for posted information by any entity or person.
5.1.2
InfoCountry takes no liability for posted information quality, truthfulness, authority, legality, veracity, safety or misappropriation.
5.1.3
InfoCountry acts as an online centralized information system to provide information from individuals to individuals for the distribution and publication of comments, notes, general facts and business detailed information. All information occurs in real time and InfoCountry has no obligation to screen data, communications or information in advance and is not responsible for monitoring, editing, verifying or otherwise control the material posted by users.
5.1.4
InfoCountry, in its sole discretion, reserves the right to remove any Information that causes interference with other users of the Service or those who do not follow the agreement of the terms and conditions or any other condition that InfoCountry believes that could violate the InfoCountry web site Service.
5.1.5
InfoCountry takes no liability for any damage or loss of data which arises on the user's equipment by using the posted information Services.

5.2 All Users agree not to do the following (Relevant to all Divisions).
5.2.1 Submitting information that is copyrighted, trademarked, patented or any other means of intellectual property laws protection, unless you are the owner of the information or you have been granted the permission in writing from the legal owner.
5.2.2 Submitting information that is; in a foul language, obscene or abusive language, sexually-explicit,  inappropriate, offensive, rude, embarrassing, defamatory, harmful, threatening, abusive, hateful, insulting, discriminating or in bad taste or any other means of information that could result in a dislike to someone else. 
5.2.3 Submitting information that is incomplete, false, misleading or inaccurate or facts that does not have a physical resource backup.
5.2.4 Submitting information about existing business; information, strategies, principles, services, business plan, mission or any information that could cause harm to a business or an individual.
5.2.5 Submitting information that is illegal to any applicable law or regulation within South Africa or any other country.
5.2.6 Submitting information that contains viruses, worms, "Trojan horses" or any other contaminating or destructive features.
5.2.7 Submitting information for charity requests, petitions, chain letters or pyramid schemes. 
5.2.8 Submitting information that could harm or offence or infringe a person or entity; physically, mentally, religiously or any other means of damages caused by the information.
5.2.9 The people that use the Service agree to, the best of their knowledge, submit information that is uplifting, in a good spirit, not confidential, accurate, complete and up to date.
5.2.10 You also agree that the information is meant for the general public and suitable for all ages.
5.2.11 You also agree to grant every individual a world-wide, unconditional, royalty-free, non-terminable license to print, use, copy, distribute, such data in any manner with or without the mention of the author.
5.2.12 You also agree that you will make the time and effort to delete your own out-dated information, if it is still accessible to you during that time (this is not enforced to anyone).

5.3 Users will also agree to the following (Relevant for InfoBiz only).
5.3.1 The information available from InfoBiz are copyrighted to a registered business.
5.3.2
The users are only permitted to view registered businesses information which is set to approved.

6. REGISTERED BUSINESSES
6.1
A registered business or Customer can be anyone who has fully and truthfully completed the registration form and who has made the necessary payment arrangements. 
6.2 A registered business will receive a user name and password (If required), a unique business reference number (JBNumber/BURN), a complete service package which includes access to the InfoBiz MIS, web space to host the registered business data, several already developed web pages to display the information, support from various people and several additional services which are all listed within the InfoBiz service documentation.
6.3 Registration is not free and requires a monthly payment.
6.4
The registered business will also confirm that the physical address shall be its domicilium citandi et executandi.
6.5 Upon registration the registered business is set to be 'Under Construction'. This condition will remain valid until all the 'recommended updates' are successfully updated.
6.6 Each registered business will be classified within one of five(5) approved stages. Each approval will have a different meaning and result, within the
InfoCountry service.
6.7 InfoCountry, in its sole discretion, reserves the right to set a registered business in any of these stages in regard to that specific registered business only. The classification for the proper approval stage for each registered business will be listed within the InfoBiz service documentation
6.8 The liability for registered businesses in perspective of payments within the different approval stages are available from the InfoBiz service documentation. All registered businesses agree to these circumstances as stated in the documentation. 
6.9 Any registered business has the right to cancel their contract with
InfoCountry at any time, in this instance they will still be liable for the payment until the end of the month of cancellation.
6.10 InfoCountry does not have the right to keep the information on their database for any other reason than;
6.10a for possible re-registration of the same cancelled business and 
6.10b for a specific time period, specified within the InfoBiz service documentation

6.11 The JBNumber is exclusively meant for a specific registered business and no one else will be allowed to use this number without the mention of that specific registered business
6.12 The registered business owner may use that number only within the perspective of their own business environment.
6.13 The user name and password which the registered business and/or Customers are issued with, will remain a secret and is not transferable. 
6.14 Anyone using the user name and password is the responsibility of the registered business and/or Customer respectively.
6.15 Any loss or unauthorized use of a registration or password or misuse of the password or registration must be reported to the Supervisor immediately as this will remain the responsibility of the registered business and/or Customer.
InfoCountry is in no way responsible or liable regarding the above mentioned.

6.16 In conjunction with section 5.3 of this agreement InfoBiz assists Editors with updating and maintaining registered businesses information. It is still the registered businesses or Customer's responsibility to evaluate the posted information for quality, truthfulness, authority, legality, veracity, safety, misappropriation, correctness, completeness, precision or any typographic misspells.
6.17 Editors will only edit registered business data on a written request from the registered businesses and/or Customers
or if permission has been granted by the legal owner.
6.18 InfoCountry in perspective to their Supervisors and Editors will take no liability for incorrect information posted on the registered business web pages due to typographical error or misunderstandings between the Editor and their registered businesses and/or Customers
6.19 Editors update registered businesses information on a periodical scale of one update per month for all the registered business pages at once. This arrangement may vary depending on the availability of the Editor but, this is not enforceable towards the Editors service contract.
6.20 A registered business may however; edit their personal information at any time or as many times as they like, by using a business editor, subject to the provisions of section 5.2.

6.21 Anyone who uses the Service must agree that the act of submitting the information within InfoBiz is in lieu of their signature. 

7. INDEMNIFICATION
7.1 InfoCountry is committed to protecting your privacy and to meet all applicable conditions for data protection. InfoCountry however will take no liability for any information which has been hacked or stolen from our databases or that which has been captured or retrieved from illegal access or abnormal operations procedures or actions, that leads to unsatisfactory conditions. 
7.2 InfoCountry is under no legal authority request to encrypt any contents or data from and to the InfoCountry web site.
7.3 You are prohibited to submit a virus or overload the Site or post any database commands in attempt to penetrate the database system. You will be held liable for any damages caused by these actions.
7.4 InfoCountry will not be liable for any cost, loss or liability to a registered business, Customer, a person or an entity which may arise from changes or suspension of names, codes or numbers allocated within the Service. 

7.5
InfoCountry uses cookies (a small text file which resides on the client computer) to personalize the web site visitor preferences for current and future use. The use of cookies on the InfoCountry web site are optional to the Services provided and does not contain any personal information about the users.
7.6 Most posting pages available within the Service, captures the users IP address and 'browser type' information.
InfoCountry will not use this information other than for the convenience of the user or InfoCountry themselves;
7.6a to improves the services of
InfoCountry and related third-parties,
7.6b or for compiling non-personal statistical information or
7.6c to set or test users personal preferences.
 

7.7 No one is permitted to access or use the MIS from either JBNetInfo, InfoTown or InfoBiz unless, they are a Customer (for accessing the InfoBiz MIS) or employed by InfoCountry with the proper permission granted (for accessing either JBNetInfo, InfoTown or InfoBiz). 

7.8 Most documents, notes or electronic information which are distributed to users, registered businesses, the public or to InfoCountry and JBNet employees are signed with a reference number, located at the bottom right corner, of every page.  This number is listed within the InfoCountry information structure. People can contact InfoCountry for confirmation of the validation of the document, note or electronic information you receive for comparing purposes. 
InfoCountry
takes no liability on information;
7.8a not containing the reference number or;
7.8b information not matching the original material detail or;
7.8c numbers which are requested that are not listed within the reference number structure.

7.9 InfoCountry takes no liability of any damage, non-received information, malfunction, spamming, incorrect information, delay time, financial loss or the contents of the data received or caused from the SMS service that InfoCountry provides. 
7.10 The length of a message is limited to 130 characters. 
7.11 InfoCountry classifies the SMS service as a 'request-respond' service and will take no liability for using the SMS service. The service is used by the users own risk.

7.12 InfoCountry takes no liability for any incorrect or non-functional E-Mail addresses or links. It is the request from InfoCountry for anyone to inform InfoCountry of any problems relating to this issue, but InfoCountry takes no liability for defects in the Service which cannot be corrected.
7.13 InfoCountry will not be liable for the links available on the site to third parties as we do not have any control over those web sites contents and services.

7.14 InfoCountry is developed from an Internet standard called; 'User or Surfers Friendly Interface or Environment' (USFIE). InfoCountry will not be liable for any concerns, correctness, validations or appropriations of this standard. The service is provided by JBNet and remains the property of the JBNet.co.za owner.
7.15 InfoCountry does not claim that this web site follows all the guidelines enclosed within the standard layout and construction.

7.16 You agree to be bound to any additional agreements subjected within the web site. 

7.17 We may transfer our rights and responsibilities under this contract to anyone else.  

8. THE AUTHORIZATION OF INFORMATION
8.1 You may print and download portions of the information from the different divisions within
InfoCountry for your own non-commercial use. 
8.2 You must agree not to change or delete any contents from the information you retrieve from the Service. 
8.3 You must agree that the information you use from the Service remains the copyright of the original author. 

8.4 You must agree not to use any robot, spider, or other automatic device, process or software to monitor or copy our web pages or any part of the contents contained herein, or download the entire web site onto your local hard drive.
8.5 You must agree to access, browse and use the Service for legal purposes only.

9. PAYMENTS
9.1 The service from InfoTown is FREE and no registration is required in accessing the information.

9.2 Businesses need to pay a small monthly installment fee in order to be a registered business and to use the centralized information system. These services and payments as-well-as all the details of the service agreements are discussed within the relevant operational policies within the InfoBiz service documentation. The registered businesses are also bound to those agreements and is an attachment to this agreement. 
9.3 Any upgrades or changes from within the service that
InfoCountry provides could be subject to additional charges or a separate agreement.
9.4 We do not bill registered businesses according to the work been done on their business detail. Registered businesses pay a once-off fee for the setup, of the service and thereafter a monthly fee for the hosting, service and support.

10. LEGAL NOTIFICATIONS
10.1
InfoCountry will not be liable for any contents not mentioned in the terms and conditions. Any contents not mentioned in the terms and conditions, that may result in a dispute or any unsatisfactory condition must first be discussed with the JBNet.co.za owner for notification and clarification, before any legal steps are undertaken. No person is permitted to make any information against InfoCountry public. In refusing to do so, InfoCountry will not be held responsible to the allegations made against the Service and InfoCountry can hold the compliant responsible to any damage or cost to InfoCountry's employees, clients or service.

10.2 InfoCountry will not be liable for costs resulting from Users if professional advice relating to these terms and conditions is obtained.  
10.3 If there is any conflict between these Terms and Conditions and the information within the service itself then the latter shall prevail.

10.4 Any disputes shall be subject to the exclusive jurisdiction of the African courts within South Africa. 
10.5 If any provision of these Terms and Conditions are found to be invalid by any court having jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

10.6 All InfoCountry users, registered businesses and employees have the rights detailed in Chapter 7 of the ECT act. The InfoCountry services, contents, software and downloads may be classified as “electronic transactions” and users may lodge complaints concerning the services which InfoCountry provides or about this agreement to the following email address: webmaster@JBNet.co.za
